Compensation

How is compensation determined ?
The severity of your permanent incapacity will dictate the amount of compensation recoverable.

There are several categories of compensation that a court examines in awarding compensation:

Permanent incapacity
An expert will be consulted to provide the court with a clear picture of your medical condition and what medical problems you may face in the future as a result of the negligence.

Economic Loss

Economic loss such as lost income, lost business revenue and loss of earning capacity if, for example, you are forced to change careers, are major issues in personal injury cases. You may also seek payment for past and future medical expenses such as medications, medical equipment and the cost of a personal caregiver even if the provider is a family member.

Cost of Future Care
When a child or adult is severely handicapped the cost of lifetime care is usually not covered by existing medicare and/or private insurance. These costs can be enormous and may constitute a major portion of the compensation you are eligible to receive. 

Pain and Suffering

Compensation will also be awarded for the pain, suffering, inconvenience and loss of companionship you have suffered. Although courts have placed a cap on this portion of the claim, spouses and children of the injured party may also be eligible for compensation.
